TEZ İ DEVRE TATİL SÖZLEŞMESİ Tezin temel konusu, devre tatil sistemi ve devre tatil sözleşmesidir. Bunun için, 1. Bölümde; devre tatil sözleşmesinin tanımı yapıldı. Devre tatil sisteminde yer alan diğer sistemlerle farkı anlatıldı. Zaman zaman Avrupa Birliği Hukukundaki devre tatil sözleşmeleri ile farkı vurgulandı. Sözleşmede yer alması gereken zorunlu koşullar belirli bir yer ve belirli bir zaman olarak verildi. Devre tatil sözleşmesi bir akitip sözleşme olarak kabul edildi. Devre tatil sözleşmesi Türk Hukukunda Tüketici Hukuku içeresinde yer alan fakat tüm koşulları düzenlenmediği için atipik bir sözleşme olarak kalan bir sözleşme olarak vurgulandı. 2. Bölümde; sözleşmenin tarafları anlatıldı. Eğer sözleşme tüketici hukuku içindeyse devre tatil sahibi tüketici olarak kabul edildi. Diğer taraf ise ünite sağlayıcı olarak adlandırıldı. Bu bölümde kişilerin hak ve borçları yer aldı. Bu bölümde temel borçlar; ünitenin teslim edilmesi, servis hizmeti verilmesi, değişimli ünite ve hafta sağlanması, devre tatil bedeli ödenmesi, süre bitiminde ünitenin terkedilmesi, diğer devre tatil sahiplerinin rahatsız edilmemesi gibi borçlardır. 3. Bölümde; devre tatil sisteminde yönetim kavramı ve yönetim sözleşmesi anlatıldı. Bölüm içinde işletme aidatı sorunları yer aldı. Tezin sonunda sistemin genel bir i ve değerlendirme yapıldı. The summery of my write contains and gives the general iformation about the system of time sharing systems and time sharing contracts. Frihst chapter: I explained the matter of time sharing and compared the contracts which has been included in time sharing system and the diffrence between different time sharing systems which placed in European Community Low. In the contract it has to have a certain place and a certain time piece. Time sharing contracts accepted as a non-typical contract and also the contract placed in a comsumer low in Turkish Low system. The reason is all matters of time sharing contract has not been arranged property. Second chapter: Explanation abaout the person placed in the contract. If the contract is in the consumer low, the owners of the time sharing, accepted as a consumer. Also in this chapter owners wrights has been explained. Checking out the units, service fees payments and peyments of time sharing, prosedures of checking, flaxible units and flaxible times (week), alsa been pointed in this chapter. Third chapter: General management of time sharing system and certain problems and details of time sharing contracts. Also monthly serving fees has been placed in this capter.
