AKİT DIŞI SORUMLULUKTA EŞYAYA İLİŞKİN ZARARLARIN TAZMİNİ Hukuki anlamda eşya, üzerinde ferdi hakimiyet sağlanabilecek, iktisadi bir değer taşıyan, şahıs dışı cismani varlıklardır. Eşyaya ilişkin zararlar akdi veya akit dışı sorumluluktan doğar. Bu tezimizde, akit dışı sorumluluk sonucu meydana gelen eşyaya ilişkin zararları ve bu zararların tazminini incelemeye çalıştık. Akit dışı sorumluluklar, kusura dayanan ve dar anlamda haksız fiil olarak da nitelendirdiğimiz fiillerden doğabileceği gibi, kusursuz sorumluluklardan da doğabilir. Eşyaya ilişkin zarar kavramı, bir malın telef olması veya hasara uğraması ile malvarlığında meydana gelen azalmayı ifade eder. Zarar; kişiye ilişkin zararlar, konumuz olan eşyaya ilişkin zararlar, fiili zarar, yoksun kalınan kar, maddi zarar, manevi zarar şeklinde ayrımlara tabi tutulabilir. Eşyaya ilişkin zararlar, maddi zarar şeklinde olabileceği gibi manevi zarara da neden olabilir. Hukuk sistemimize uygun olarak öncelikle zararın tayinini, sonra tazminatın belirlenmesini inceledik. Eşyaya ilişikin zararın tayin edilmesinde iki teori vardır. Objektif veya soyut hesaplama yöntemine göre zararın hesabında, telef olan veya hasara uğrayan eşyanın piyasada oluşan rayiç değeri dikkate alınır. Subjektif veya somut hesaplama yöntemine göre ise, telef olan veya hasara uğrayan eşyanın, zarar görenin malvarlığında bulunan diğer mallarla ilişkisi ve kullanıldığı amaç dikkate alınarak zarar hesaplanır. Zarar verici fiil sonucu zarar gören birtakım kazançlar elde etmişse, bunlar zarar miktarından düşürülür. Buna zararın denkleştirilmesi denir. Zararın tayininden sonra tazminatın tayini yoluna gidilmektedir. Tazminatın üst sınırını meydana gelen zarar oluşturur. Zarar ve tazminat belirlendikten sonra, tazminat miktarından, zarar verene veya zarar görene özgü durumlar yahut bir takım özel durumlar varsa bunlar indirilir. Burada temel amaç, tazminat miktarının, zarar miktarını aşmamasıdır. ABSTRACT Compensation of the losses on the goods due to a non-contractual liability From the legal point of view, goods are the things other than persons, with an economic value on which an individual domination can be established. The losses related to the goods arise out of contractual and non-contractual liabilities. In this study, we tried to review the losses caused on the good due to a non-contractual liability and compensation thereof. Non-contractual liabilities include the acts based on default or the acts which can be described as unjustifiable act from a narrower perspective or the liabilities without a default. The concept of loss in relation with the good describes loss or damaging of the good or a reduction in the assets. Losses can be classified as personal losses, losses related to the good in question, actual losses, loss of profit, pecuniary damages, intangible damages. The losses on the good may be pecuniary or intangible. We have first reviewed determination of the loss then the compensation. There are two theorems on determining the loss on the good. In calculation of the loss according to objective or abstract calculation method, the market value of the good lost or damaged is taken into account. According to subjective or concrete calculation method, the relation of the lost or damaged good with the other assets of the party suffering the loss and its purpose of use shall be considered in calculation of the loss. In the event the party suffering loss has enjoyed some gains after the loss, these shall be deduced from the loss calculation. Loss determination is followed by compensation. The upper limit of the compensation is the loss suffered. After finding out the loss and compensation, the amounts peculiar to the party suffering or causing loss or other deductibles shall be deduced with the aim being that the compensation should not exceed the loss.
