Özet:ÖZET Çalışmamızın konusunu Türk Ceza Kanunu 245. maddede düzenlenen “Banka veya Kredi Kartlarının Kötüye Kullanılması Suçu” oluşturmaktadır. Söz konusu suç Türk Ceza Kanununun “Topluma Karşı Suçlar” başlıklı Üçüncü Kısmının, “Bilişim Alanında Suçlar” başlıklı Onuncu Bölümünde düzenlenmiştir. Çalışmamız dört bölümden oluşmaktadır. Birinci bölümde bu suçların anlaşılması için gerekli terimlere ve genel açıklamalara yer verilmiştir. Türk Ceza Kanunu 245. maddesinde yer alan suç tek bir madde altında toplanmış olsa da bünyesinde birbirinden bağımsız üç farklı suçu barındırmaktadır. Bu maddenin birinci fıkrasında gerçek bir banka veya kredi kartının kötüye kullanılması suçu, ikinci fıkrasında banka veya kredi kartının sahte olarak üretilmesi, satılması, satın alınması, devredilmesi ve kabul edilmesi suçu, üçüncü fıkrasında ise sahte oluşturulan veya sahtecilik yapılan banka veya kredi kartı ile yarar sağlanması suçu düzenlenmiştir.Çalışmamızın ikinci bölümünde gerçek bir banka veya kredi kartının kötüye kullanılması suçu, üçüncü bölümünde banka veya kredi kartının sahte olarak üretilmesi, satılması, satın alınması, devredilmesi ve kabul edilmesi suçu,dördüncü bölümünde sahte oluşturulan veya sahtecilik yapılan banka veya kredi kartı ile yarar sağlanması suçu tüm unsurlarıyla beraber ayrı ayrı değerlendirilmiştir. Bu değerlendirme yapılırken hem bu maddede yer alan suçların birbirinden farklarına hem de Türk Ceza Kanunu ve diğer özel ceza kanunlarında yer alan suçlarla farkına değinilmiştir. Ayrıca değerlendirme yapılırken doktrinde yer alan farklı görüşlere ve Yargıtay kararlarına yer verilmiştir. Çalışmamızın sonunda konuya dair özet bilgilerin ve konu hakkında kanaatimizin bulunduğu sonuç bölümü ile çalışmamızda yararlandığımız kaynaklar bulunmaktadır. -------------------- ABSTRACT The subject of our study is the “Offence of Misuse of Bank or Credit Cards” which is regulated in Article 245 of the Turkish Criminal Law. The mentioned offense is regulated in Section 10 titled “Offences Related to Data Processing/Informatics Systems” of Part 3 titled “Offences against the Public” in Turkish Criminal Law. Our study consists of four sections. In the first section, the necessary terms and general explanations have been provided so that these offences can be understood well. Although the offence included in Article 245 of the Turkish Criminal Law is a single item, in fact it covers three different offences which are independent from each other. In the first clause of this article, the offence of misuse of bank or credit cards is regulated; in the second clause, the offence of producing, selling, purchasing, transferring, or receiving a counterfeit bank or credit card is regulated and in the third clause, the offence of securing a benefit for himself or another by using a counterfeit or falsified bank or credit card is regulated. The offence of misuse of bank or credit cards in the second section of our study, the offence of producing, selling, purchasing, transferring, or receiving a counterfeit bank or credit card in the third section, the offence of securing a benefit for himself or another by using a counterfeit or falsified bank or credit card in the fourth section have been evaluated separately with all their elements. While carrying out this evaluation, both the differences between the offences set forth in this article and the differences of them with the offences specified in Turkish Criminal Law and other special penal laws are mentioned. In addition, different opinions on the doctrine and the decisions of the Supreme Court have been included while carrying out the evaluation. At the end of our study, we have a conclusion section in which there are summary information and our comments on the topic and the references showing the resources from which we have benefitted in our study.
