Anahtar Kelimeler : Vergi Hukuku, Özel Hukuk, Vergiyi Doğuran Olay, Özel Hukuk Sözleşmeleri VERGİ HUKUKUNUN ÖZEL HUKUK İLE İLİŞKİSİ Vergi hukuku; verginin tanımı, verginin doğması ve sona ermesi gibi kavramları incelerken ister istemez özel hukuk dallarıyla münasebette bulunacaktır. Verginin ortaya çıkması ve sona ermesi aşamasında, vergi hukukunun özel hukuk ile ilişkisi doğrultusunda muvazaa ve peçeleme önemlidir. Muvazaa ve Peçeleme vergiden kaçınma yolları olarak kullanılmaktadır. Bu hususta “vergiyi doğuran olay” ve “ekonomik yaklaşım ilkesi” önemlidir. Ekonomik yaklaşım ilkesi sözleşmenin ötesine geçerek gerçek iktisadi boyutu bize verir. Ticaret şirketlerinde “bölünme” ve “devir” konusunda verginin ortaya çıkıp çıkmaması da bu ilişki çerçevesinde değerlendirilmelidir. Bölünme ve devir müessesesinin Türk Ticaret Kanunu’nda değilde Kurumlar Vergisi Kanunu’nda düzenlenmiş olması dikkat edilmesi gereken bir durumdur. Vergi hukuku özel hukuk ilişkisinde bizce önemli olan nokta kamu hukuku geleneğinden gelen vergi hukukunun, vergi hukuku açısından sonuç doğurması hususunda kendi ilkelerinin daha baskın olduğudur. Özel hukuka ait kavramları elbette kullanmaktadır. Özel hukuka ait düzenlemeleri elbette göz önüne almaktadır. Ancak her seferinde durum vergi hukukunun temel yapı taşı olan vergi, dolayısıyla vergiyi doğuran olay açısından göz önüne alınmaktadır ve bu da vergi hukukunun düzenlemeleri doğrultusunda sonuçlanmaktadır. Keywords : Tax Law, Private Law, Private Law Contracts, Event Giving Rise To Tax ABSTRACT THE RELATION BETWEEN PRIVATE LAW TO TAX LAW While analyzing concepts like the definition of tax, the birth and ending of tax, the Tax law, necessarily, will be connected with branches of the private law. In the phase of the birth and ending of the tax, collusion and tax-veiling are important within the relationship of the tax law with the private law. Collusion and tax-veiling are used as ways to escape tax. In this respect, the principles of “taxable event” and “economic approach” are important. The economic approach principle gives us the economic dimension by passing beyond the contract. The taxability of “the transfer” and “the split” in trade companies should be analyzed within the frame of this relationship. It is a noteworthy situation that the agency of transfer and split is organized not in Turkish Trade Law but in Corporate Tax Law. The important point for us in the relationship between the Tax law and the Private Law is that the principles of tax law, coming from the tradition of the public law, are more dominant in respect of producing results concerning tax law. Of course, concepts of the private law are also used. Arrangements of private law are also considered. However, the case is always considered with respect to tax, the basic unit of the tax law, consequently as taxable event and, then, this results in the direction of tax law regulations.
