Özet:Belediye zabıtası, beldenin düzenini muhafaza eden, belde halkının esenlik, sağlık ve huzurunu koruyan, yetkili organların bu amaçla alacakları kararları uygulayan belediye yönetimine bağlı özel kolluk gücüdür. Yerelleşme tartışmaları çerçevesinde, yerel yönetimlerin güçlendirilmesi ve yetkilerin merkezden yerele aktarımı günümüzün en önemli olgularındandır. Yerel yönetimlerin yetkilerinin arttırılması, yerel hizmetlerde çeşitliliğin artmasına neden olmuştur. Yerel yönetimlerin belde halkının ihtiyaçlarını karşılama noktasında yapmış olduğu bu hizmetleri sunabilmesi ve yerel yönetim birimlerince alınan kararların uygulanmasının sağlanması adına belediye zabıtası önemli bir rol üstlenmektedir. Yerel yönetimlerin hizmet sunumunda en önemli birimlerden olan belediye zabıtasının görev alanının sınırlarında ortaya çıkan sorunlar ve bu sorunların nedenlerinin sorgulandığı bu çalışmada; ilk bölümde belediye zabıtasına kanun, yönetmelik ve ilgili mevzuatlarda verilen görevlerin neler olduğu tespit edilmiştir. İkinci bölümde ise bu görev ve sorumlulukları yerine getirirken belediye zabıtasının karşı karşıya kaldığı sorunlara değinilmiştir. Bu bağlamda zabıtanın görev alanının sınırlarında, yani büyükşehir ve ilçe belediye sınırlarında, zabıta - polis ve zabıta - jandarmanın yetki alanı sınırlarında ortaya çıkan sorunların neler olduğuna yer verilmiştir. Günümüzde halen belediye zabıtasının geleceğine ilişkin farklı görüşler bulunmakla birlikte, yerelleşme ile birlikte yerel yönetimlere verilen sorumluluğun artmasına paralel olarak belediyelerde nitelikli ve uzmanlaşmış belediye zabıtasına olan ihtiyaç daha da artmış bulunmaktadır. Anahtar Kelimeler: Belediye Zabıtası, Özel Kolluk Kuvveti, Yerel Yönetimler, Belediye Zabıtasının Sorunları ABSTRACT Municipal Police is the law enforcement force under the control of the local government, which maintains the order of the cities and protects welfare, health and peace of the inhabitans and which implements any decision adopted by the authorized bodies with such regards. Under the framework of localization debates, one of the most significant facts of the recent times is to strengthen the local governments and to transfer the authorities from central to local authorities. Extension of the Powers of the local governments has multiplied variety in respect of local services. The municipal police play a major role in offering such services realized in order to meet any needs of the inhabitants and implementing any decisions adopted by the units of the local authorities. Under the scope of this study, where the troubles arising within the limits of the field of responsibilities assigned to the municipal police, being one of the major units of the local governments in terms of offering services and reasons of such troubles are questioned; the first part focuses on the determinations on the duties assigned to the municipal police under the framework of the laws, the regulations and the relevant legislations. As for the second part any troubles, suffered by the municipal police while fulfilling such duties and responsibilities are mentioned. In this context any troubles arising within the limits of field of responsibilities assigned to municipal police, namely at the limits of metropolitan and local municipalities and within the limits of field of power granted to municipal police – police officers and municipal police – gendarme are described. Different opinions in relation to the future of the municipal police survive however, on the other hand the need for qualified and specialized municipal police has increased in line with the increase in the responsibilities assigned to the local governments, due to the localization matters.
