The legitimate aim test in the Case-law of the European Court of human rights

Özet:

İnsan Hakları Avrupa Mahkemesinin (“Mahkeme”) pek çok kez belirttiği gibi, İnsan Hakları Avrupa Sözleşmesi (“Sözleşme”) ile güvence altına alınmış hakların kullanımına yapılacak tüm müdahaleler bir meşru amaç izlemek zorundadır. Buna karşın, özel olarak Mahkemenin meşru amaç incelemesine yoğunlaşan oldukça az sayıda yazın bulunmaktadır. Bahsedilen boşluğu ve meşru amaç incelemesinin Mahkeme içtihadında artan önemini çıkış noktası olarak alan bu çalışma, meşru amaç testini bütüncül bir yaklaşımla ele almakta ve testin -tartışmalı- etkililiğini, temel soru ve süjesini, ispat külfeti ve delil problemlerini, tespit edilen bir meşru amacın çeşitli işlevlerini ve meşru amaç ihlallerinin ortak yanlarını incelemektedir. Testin kendisine dair inceleme tamamlandıktan sonra çalışma, Sözleşme tarafından sayılan ve/veya Mahkeme tarafından meşru olarak kabul edilen amaçlara yoğunlaşmaktadır. Kapsamlı bir inceleme gerçekleştirmek adına Mahkemenin karar veritabanında Kasım 2018 tarihine kadar mevcut olan ve içerisinde “legitimate aim” ifadesi geçen tüm kararlar incelenmiş ve bu kararlardan yaklaşık dokuz yüzü tezde referans olarak alınmıştır. Çalışma, meşru amaç testinin yürütümüne ve meşru amaçların yorumuna ilişkin Mahkeme içtihadındaki bir çok uyumsuzluğu ortaya koymakta ve Mahkemenin bu tutarsızlıkları gidererek meşru amaç testine dair yaklaşımında daha tutarlı olması gerektiğini tez edinmektedir. Ayrıca çalışmada başvurucuların (eğer varsa) izlenilen amaca dair itirazlarını kapsamlı ve uygun bir biçimde ortaya koymaları gerekliliği ve hükümetlerin temel hakların kullanımına ilişkin sınırlamalar getirirken tüm safhalarda bir meşru amaç izlendiğini ortaya koymaları gerekliliğine vurgu yapılmaktadır. -------------------- As the European Court of Human Rights (“the Court”) held in multiple cases, every interference with the enjoyment of a right that is guaranteed under the European Convention on Human Rights (“the Convention”) must pursue an aim that is legitimate in the sense of the Convention. That being so, there are only a handful of studies in the literature that specifically address this inquiry of legitimate aims. Being aware of this gap and the increased importance of the legitimate aim assessment in the Court’s case-law, this study specifically examines the legitimate aim test as a whole, by asking questions on its -disputed- effectiveness, material question and subject, questions of burden of proof and evidence, functions of an identified legitimate aim and the common features of the aim violations. After analysing the test itself, the study shifts its focus to the aims, more precisely, the aims that are legitimate in the sense of the Convention, be them expressly deemed legitimate by the text of the Convention or found legitimate by the Court in respect to certain interferences. To carry out a comprehensive analysis, every judgment that was available in the Court’s database by November 2018 that contains the phrase “legitimate aim” had been examined and almost nine hundred of them had been used as reference. The study reveals several inconsistencies in the practice of the Court, both in the execution of the legitimate aim test and in the interpretation of the aims, and concludes -inter alia- that the Court should be more predictable in its approach to the test. It also concludes that the applicants should raise proper objections to the legitimacy of the aim pursued (if any), and the Governments should demonstrate a legitimate aim was pursued at all stages for successfully justifying an interference with a Convention right.
