Özet:

Anayasa’nın, “Temel Haklar ve Ödevler” bölümünde, “Hak Arama Hürriyeti” başlığı altında 36. maddede bir temel hak olarak düzenlenen savunma hakkı, şüphelinin ve sanığın sahip olduğu en önemli haklardan biridir. Savunma hakkı, suç isnadı altındaki kişinin kendisini savunması için gerekli hukuki imkanlardan oluşur. Bu bağlamda savunma hakkı; susma ve kendi aleyhine delil sunmama, dosya inceleme ve dosyadan örnek alma, müdafiden yararlanma, tercümandan yararlanma, soru sorma, savunma delillerinin toplanmasını talep etme ve delil sunma, duruşmada hazır bulunma gibi şüphelinin ve sanığın savunması için gerekli temel hakları kapsar. Savunma hakkı kapsam itibariyle oldukça geniş bir hak olmasına rağmen mevcut yasal düzenlemeler savunma hakkının da sınırları olduğunu göstermektedir. Bu hakkın kapsamı altındaki her bir hakkın ayrı ayrı birtakım sınırları bulunmaktadır. Dolayısıyla şüpheli ve sanık, savunma hakkını ancak bu sınırları aşmayacak şekilde kullanabilir. Çalışmamızda, şüphelinin ve sanığın sahip olduğu savunma hakkının sınırları; ulusal mevzuat, uluslararası sözleşmeler ve içtihatlar doğrultusunda incelenmiştir. İki bölümden oluşan çalışmamızın birinci bölümünde; şüpheli, sanık ve savunma kavramsal olarak tanımlanmış ardından bir hak olarak savunmanın tarihsel gelişimi, bu hakkın özellikleri ve kullanım şekilleri açıklanmıştır. İkinci bölümde; savunma hakkının kapsamı itibariyle susma, dosya inceleme ve dosyadan örnek alma, tercümandan yararlanma, duruşmada hazır bulunma, iddia tanıklarına soru sorma, savunma delillerinin toplanmasını talep etme ve delil sunma haklarına dair genel bilgiler verilmiş olup ardından şüphelinin ve sanığın bu haklarını kullanırken yasal olarak ne kadar ileri gidebileceği irdelenmiştir. -------------------- In the Fundamental Rights and Duties section of the Constitution, the right to defense, which is regulated as a fundamental right under Article 36 Freedom of Rights are is one of the most important rights of the suspect and the accused. In this respect, although the right to defense is quite broad in scope, the existing legal regulations. The existing legal regulations show that the right to defense has limits. Therefore, the suspect and the accused may use the right to defense only if they do not exceed these limits. In the first part of our two-part study; The concept of the suspect, the defendant and the defense is defined conceptually, then the historical development of the defense as a right, the characteristics of this right and its usage methods are explained. In the second part; rights within the scope of defense rights will be examined in general. Then, the question of how the suspect and the defendant can go legally when using these rights are examined.
