Özet:Çalışmanın amacı; Türkiye’de profesyonel futbol teknik adam sözleşmesini hukuki yönüyle tetkik etmek ve teknik adamların yaşadıkları hukuki problemleri tespit etmektir. Çalışma, kuramsal (literatür) ve uygulama (mülakat) bölümü olmak üzere iki ayrı bölümden oluşmaktadır. Literatür bölümü Kavramsal Çerçeve başlığı altında bu sözleşme türünün özellikle İş Hukuku yönünden ayrıntılı olarak değerlendirilmesinden oluşmaktadır. Bu bölümde sözleşmeler ile ilgili temel kavramlar, bu sözleşmenin ana esasları, sözleşmeden doğan karşılıklı borçlar, işin düzenlenmesi, toplu iş hukuku ile ilişkisi, sözleşmenin sona ermesi ve sonuçları ile uyuşmazlıkların çözümü başlıkları altında sözleşmenin kurulmasından sona ermesine kadar tüm hukuki süreç değerlendirilmiştir. Uygulama kısmında ise mülakat tekniği uygulanarak 18 teknik adam ile görüşülmüştür. Teknik adam seçiminde daha önce Türkiye’de veya yurtdışında bir profesyonel futbol kulübünde çalışmış olma ölçüt olarak kullanılmıştır. Araştırmada profesyonel futbol liglerinin her seviyesinde görev çalışan / çalışmış teknik adamlarla görüşülmeye gayret edilmiştir. Burada teknik adamlara önceden belirlenmiş sorular sorulmuş ve yaşadıkları sorunlar tespit edilmeye çalışılmıştır. Araştırma sonucunda profesyonel futbol teknik adamların beyanlarına göre, teknik adamların; Türkiye Futbol Federasyonu (TFF) ile ilgili özellikle iletişim açısından problemleri olduğu, TFF Hukuk Kurulları konusunda bir takım olumsuz tespitleri olduğu, teknik adamların sendikal yapılanmaları desteklemelerine rağmen mesafeli yaklaştıkları, futbol alanında faaliyet gösteren mesleki derneklerin verimli çalışmadıkları, sözleşme görüşmelerinde sıkıntılar yaşadıkları, haklarını çoğu zaman alamadıkları, ücretlerinin tam ve zamanında ödenmediği tespit edilmiştir. Anahtar sözcükler: spor hukuku, iş hukuku, futbol, teknik adam, iş görme sözleşmeleri, SUMMARY PROFESSIONAL FOOTBALL COACHING CONTRACT AND ITS IMPLEMENTING PROBLEMS FROM A LEGAL PERPECTIVE The aim of this study is to review professional football coaching contracts in legal perspective and investigate the legal problems of active coaches in the Professional Turkish Football Leauges. This study consists of two parts; theoretical part and field study part. The Theoretical part includes particularly the contractual aspects the Turkish Labour Law. In this part all legal process from the start to the end of the contract included the following subheadings: “basic concepts”, “basics of the contract”, “reciprocal obligations”, “work plan”, “relationship between coaching contract and collective agreement law”, “termination of contracts and its results” and “dispute resolution”. The field study consists of interviews with 18 coaches. We looked for the coaches who are currently working and those who worked before with a professional coaching contract in Turkey or abroad. In this study we attempted to choose coaches from every level of professional football leagues in Turkey. During the interviews we asked questions to the coaches in order to understand and find out their contractual legal problems. At the result of this study, we found out that the coaches had; some communication problems with Turkish Football Association (TFA), especially in the area of education programmes of the coaches, some had negative opinions against the Legal Departments of TFA and the current professional football associations. Furthermore, this study proved that the coaches kept their distance to the union structure. The coaches also had problems in contract talks and with the contractual rights especially with the payments. Key words: Sport Law, Labour Law, Football, Coaching, Freelance contracts.
