Türkiye Cumhuriyeti hukukunun önemli unsurları arasında bulunan yerel yönetimlerin kurumsal kökeni dolaysız olarak Osmanlı Devletine uzanmaktadır. Yalnızca mevcut belediyelerin kuruluş tarihleri nazara alındığında dahi bunların önemli bir kısmının on dokuzuncu yüzyıldan beri varlıklarını devam ettirdiği görülmektedir. Osmanlı hukuku söz konusu olduğunda, idari sistem içinde yerel yönetimlere dikey olarak birkaç farklı katmanda ve yatay olarak birbirinden farklı türlerde yer verildiğini ifade etmek gerekir. Durumun böyle olmasında, özellikle Tanzimat öncesi dönemde Avrupa kökenli modern idari yapıdan ziyade Osmanlı Devletine özgü bir idari yapılanmanın mevcut olması etkilidir. Tanzimat'ın ilanından sonra Avrupa'daki idari sistemlerin ve özellikle Fransız tipi yönetim birimlerinin Osmanlı Devletine adapte edilmeye başladığı söylenebilir. Adaptasyonu amaçlayan yeni normlar ve bu normların meydana getirdiği idari yapılar, devletin sona ermesine kadar devamlı olarak değişme ve gelişme aşamaları kaydetmiştir. Sürecin uzun olmasında etkili olan bir faktör, Osmanlı Devletinde karar alıcı makamların idari reformları hayata geçirme konusunda tereddüt yaşamamalarına karşın, gerek yetkin bir modern yerel bürokrasinin gerekse de toplumun bu yerel bürokrasiye uyumunun derhal ortaya çıkmamasıdır. Ancak sürecin sonunda Osmanlı Devletinde yerel yönetim anlayışının yerleştiğini, temel normlarının belirdiğini ve Türkiye Cumhuriyetinin devraldığı modern yerel yönetim birimlerinin ve bürokrasisinin oluştuğunu söylemek gerekir. Bu bildiride, Osmanlı yerel yönetimler hukukunun Tanzimat'tan önce ve sonraki dönemlerine ait genel çerçevesini göstermeyi hedefliyorum. Bildiride öncelikle yerel yönetim tabirinin Osmanlı hukukundaki karşılıklarını ele alacağım. Ardından Tanzimat öncesi dönemde yerel yönetim fonksiyonunu üstlenen birimler ve bu birimlerin üst yönetimde bulunan idari makamları tanıtacağım. Daha sonra modern yerel yönetim anlayışının Tanzimat'tan sonra Osmanlı hukukunda ortaya çıkışı ve gerek hukuksal gerekse kurumsal altyapısını tanıtacağım.
The institutional origins of local governments, which are among the significant elements of the law of the Republic of Turkey, directly extend to the Ottoman Empire. Even when we pay attention only to the establishment dates of the existing municipalities, we see that a significant part of them have continued their existence since the nineteenth century. Regarding Ottoman law, I should note that local governments were included in several different layers vertically and in different types horizontally within the administrative system. That is because there was an administration specific to the Empire rather than a modern one of European origin, especially in the pre-Tanzimat period. One can say that after the declaration of Tanzimat, administrative systems in Europe, and especially French-type administrative units, began to be adapted to the Empire. New norms aimed at adaptation and the administration created by these norms constantly changed and developed until the end of the state. One factor that contributed to the length of the process was that, although the decision-making authorities in the Empire did not hesitate to implement administrative reforms, neither a competent modern local bureaucracy nor the society's adaptation to this local bureaucracy emerged immediately. However, at the end of the development process, the understanding of local government became popular in the Ottoman Empire. In this paper, I would like to show the general framework for Ottoman local government law before and after the Tanzimat. I will first discuss the equivalent of the term "local government" in Ottoman law. Then, I will introduce the units that undertook the local government function in the pre-Tanzimat period and the administrative authorities at the top of these units. Then, I will introduce the emergence of the modern approach to the local governments in Ottoman law after the Tanzimat and its legal and institutional infrastructure.
