Özet

Whether there is a victim in every crime is one of the most widely discussed issues in criminal law. The generally accepted view on this issue is that every crime has a victim. For this reason, in crimes that do not have a concrete victim, it is accepted that the public or all individuals constituting the society are victims. The Turkish Penal Code has named such offences as ‘offences without a specific victim’. In the case of offences without a specific victim, it is an important question who has the right to appeal against non-prosecution decisions. The Code of Criminal Procedure states that only persons who have been harmed by the offence have the right to object to these decisions. In practice, in cases where persons who are not harmed by the offence and who do not have the right of objection file an objection, this objection is accepted as valid by the competent authority and as a result, a public case is initiated, which brings many problems. Likewise, it is observed that after the case is filed, persons who do not have the title of victim of the offence may request to participate in the case and may even apply for legal remedy against the judgement. In this article, the issues of whether the persons concerned have the right to object to non-prosecution decisions, to participate in the public case and to apply for legal remedies in crimes whose victim is not a certain person, due to the fact that they have the title of informant or complainant, although they are not harmed by the crime, are examined.
