TBK m. 14 f. 2 adi yazılı şeklin gerçekleşmesi için alternatif yollar önermektedir. Bu yollardan biri de teyit edilmiş faks iletisidir. Faks iletilerinde teyidin nasıl gerçekleşeceği tartışmalıdır. Bir görüş teyidi faksı alanın yapacağını söylemektedir. Diğer görüş, teyidin faksı gönderen tarafından yapılacağı fikrini benimser. Bu çalışmada teyidin faksı alan tarafından yapılması gerektiği düşüncesi yönünde tavır alınmıştır. Faksı gönderen tarafından yapılan teyidin özel bir yolla gerçekleşmesi gerekliliği üzerinde de ayrıca durulmuştur. Buna göre, beyan sahibi, öncelikle, el yazısıyla imzasını içeren yazılı bir metin oluşturmalıdır. Sonra el yazısıyla imzasını içeren bu orijinal metni faks yoluyla karşı tarafa göndermelidir. Bir sonraki adım olarak, ıslak imzalı orijinal metin faks alıcısına ayrıca gönderilmelidir. Orijinal metnin gönderilmesi önceden faks yoluyla iletilen beyanın teyidi anlamına gelir. Böylelikle faks yoluyla iletilen beyanın gerçekliği ve beyan sahibinin kimliği doğrulanmış olur. Üstelik karşı taraf ispat açısından değer taşıyan bir belge elde etmiş olur.
Article 14/2 of TCO provides alternative ways for the realisation of regular written form. The approved fax message is one of them. There is a controversy on how the approval is made. A point of view states that the approval is made by the party receiving the fax message. Another point of view embraces the idea that the approval should be made by the party sending the fax message. We are in favor of the second opinion. The approval of the party sending the fax message should be performed in a specific manner. The mentioned party must primarily create a text that includes a hand written signature. Then this text should be transferred to the other party via fax message. Followingly the original text containing the hand written signature must seperatly be delivered to the receiving party. Sending out the original text means it is an approval of the below mentioned fax message. Through this procedure the authenticity of the declaration and the identity of the sender is confirmed. The document reaching to the other party has also a proof value.
