İflâs kurallarının amacı, borçlunun ekonomik durumunun düzeltilmesi
imkânının olması, borçlunun içine düştüğü ekonomik sıkıntıların zamanında fark
edilip buna karşı lüzumlu tedbirlerin vakitlice alınması ya da alacaklıların
borçlunun malvarlığı ile bu alacaklarına kavuşmasının halen mümkün olması
halinde iflâsın meydana gelmesinin önüne geçilmesidir. Bu hallerin aksinin
gerçekleşmesi ve iflâsın meydana gelmesi halinde ise borçlunun ve alacaklıların
menfaatleri arasındaki denge muhafaza edilerek, müflisin haczedilebilir mallarının belirli bir tasfiye çerçevesinde satılması ve iflâs alacaklılarının
mümkün mertebe en fazla ve eşit şekilde tatmin edilmesine imkân verilmesidir.
Çalışmamızda iflâs kurallarının amacı klasik (geleneksel) anlayış ve yenilikçi
anlayış şeklinde bir sınıflandırmaya tabi tutulup ilgili yaklaşımların icra ve iflâs
Kanunu ve Alman Aciz Kanunu bakımından değerlendirilmesine çalışılacaktır.
Bu bağlamda Türk hukuku bakımından mehaz niteliğinde olan İsviçre
hukukunun ilgili hükümleri de kısmen değerlendirilecektir.
The primary aim of the bankruptcy rules is to prevent the occurrence of
the bankruptcy of the debtor if there is an option to ensure the economic recovery
of the debtor, the economic distress of the debtor to be noticed in time and the
necessary measures are taken in a timely manner or if it is still possible to pay
the debts without following the bankruptcy procedure. In case of the occurrence
of the contrary and bankruptcy, the balance between the interests of the debtor
and the creditors shall be maintained, the assets of the bankrupt shall be sold
within a certain liquidation and the creditors shall be satisfied as much as
possible and equally. In this study, the aim of bankruptcy rules will be classified
as classical (traditional) and innovative doctrine, and the related approaches will
be evaluated in terms of Enforcement and Bankruptcy Code and German
Insolvency Code. As approaching Turkish law, Swiss law which is the referring
law will be partially considered.
