Köy Enstitüleri hakkında sosyal ve beşeri bilimlerin çeşitli dallarında çok sayıda araştırma yapılmıştır. Enstitülerin açılmasından günümüze kadar Enstitü mezun veya mensuplarının kaleme aldığı pek çok eser, Enstitülerin Türk eğitim tarihindeki yerine ilişkin sosyolojik, siyasi ve ekonomik analizleri beslemektedir. Fakat bu kurumların normatif altyapısı üzerine hukuki araştırmaya halen ihtiyaç duyulmaktadır. Söz konusu ihtiyacın iki yönü bulunmaktadır: İlk elde Enstitü teşkilatının Türk hukuk düzenindeki kanuni temellerini ortaya çıkarmak gerekmektedir. Diğer yandan, meselenin pozitif hukuk yönünden ötede, Enstitüleri çağının hukuki tartışmalarının içinde değerlendirmek önem arz etmektedir. Bir makale boyutunda tasarlanan bu çalışmada iki amaçtan birincisi hedeflenmektedir.
A great deal of research has been done about the Village Institutes in various branches of social and humanities. Many works written by graduates or members of the Institute since the opening of the institutes have fostered sociological, political and economic analysis of the Institutes' place in the history of Turkish education. However, legal research is still needed on the normative infrastructure of these institutions. The need in question has two aspects: First, it is necessary to reveal the legal foundations of the Institute's organization in the Turkish legal order. On the other hand, it is important to evaluate the Institutes in the legal debates of the era beyond the positive legal aspect of the issue. In this study, which I designed in an article size, I aim for the first of two goals.
