Abstract:Hz. Peygamber’in Kur'ân-ı Kerîm ışığında takip ettiği teşrî siyaseti incelendiğinde bunun içerisinde zaman, mekan, durum ve şahıs unsurlarının önemli bir yer teşkil ettiği kolaylıkla fark edilebilir. Resûlullah’ın, bir konuda hüküm verirken, muhatap olduğu şahısları ihmal etmediğinin göstergelerinden biri, sünnette şahsa özel nitelikli bazı uygulamaların vârid olmasıdır. Sünnetteki uygulama örneklerinin, kendilerinden hüküm çıkarmada istifade edilmesi açısından, genel ve şahsa özel şeklinde kategorik bir ayrımı mevcut olmamakla birlikte, kaynaklarımızda belirli uygulamalar hakkında “kişiye özel ruhsat” ve “kişiye özel uygulama” kayıtlarının mevcut olduğu görülmektedir. İşte bu tezin konusu, Resûlullah’ın sünnetinde vârid olup da şahsa özel olarak nitelendirilen bir takım uygulamalardır. SUMMARY As it is looked upon the ‘tesri’ policy of Prophet Muhammed in the light of Kur’ân-ı Kerîm; it can be easily revealed that the components of space, time, condition and individual do have a significant position. An indication of the fact that Prophet does not ignore individuals while making a judgment on a particular topic is the existence of individual-specific applications seen in Sunna. Although there is no such categorical distinction as general or individual in Sunna practices, as they are made use of in law-making process, in our resources the markings of ‘individual-specific permission’ and ‘individual-specific application’ can be seen. Eventually, the topic of this thesis is the applications existing in ‘sunna’ of Prophet marked as individual-specific.
