Özet:

Bir kişinin malvarlığında isteği dışında meydana gelen azalmaya maddi zarar denir. Rıza dışında meydana gelen azalma fiili zarar veya kâr mahrumiyeti olarak karşımıza çıkar. Fiili zarar, malvarlığının aktifinin azalması ya da pasiflerinin artması şeklinde gerçekleşir. Kâr mahrumiyetinde ise aktiflerin artmasına veya pasiflerin azalmasına engel olma söz konusudur. Bu iki zararın toplamı, bir kimsenin uğramış olduğu zararı, yani malvarlığında rıza dışında meydana gelen azalmayı oluşturur. Tazminatın zararı giderilmesine yönelik işlevi dikkate alındığında borçlar hukukunda sadece maddi açıdan hesaplanabilen yani parasal olarak ölçülebilen bir zarar anlayışı mevcuttur. Özellikle zararın belirlenmesinde karşımıza çıkan menfaat (interesse) kavramı, sorumluluk hukuku alanında kendinden sıkça bahsettirmektedir. Menfaat kavramının ne anlama geldiği hususunda fikir birliği mevcut değilse de bu kavramın temelleri Roma hukukuna kadar inmektedir. Roma Hukuku’nda, zararı ifade etmek için, damnum kavramı kullanıldığı gibi interesse’de kullanılmıştır. Interesse ile, zarar görenin, zarar veren olay ve bu olayın sonuçlarının gerçekleşmemesindeki menfaat kastedilirdi. ABSTRACT Material damage is defined as the loss in one’s property suffered by the person against her will. The loss in the property incurred against right-holder’s will generally comes out as actual damage (damnum emergens) or profit deprivation (lucrum cessans). Actual damage appears either as decrease in the active (positive) side of one’s property or increase in the passive (debts-negative) side of one’s property. In the case of profit-loss or profit-deprivation, either the active side of one’s property is prevented to increase or the passive side of one’s property is barred to decrease. The totality of these two types of damage is the one’s material loss incurred against her will. Taking the role of the law of compensation in the indemnification of the loss into account, the only notion of damage in the law of obligations is said to be the concept of pecuniary damage. The concept of interest (interesse), especially in the characterization of the loss, is of high significance to the law of liability. Roots of the concept of interest go back to the Roman law though no consensus among scholars on the definition of the concept does exist today. In Roman Law, the concept of damnum as well as interesse are used to express the damage By the expression of id quod interest it was referred to the interest of the person in the case of the absence of damaging event and its consequences.
