KAT MÜLKİYETİNDE ORTAK GİDER VE İFASI Kat Mülkiyeti Yasası, yürürlüğe girdiği haliyle, tek parsel üzerinde her biri ayrı gayrimenkul niteliğinde olan bağımsız bölümler ile bu bölüm maliklerinin aralarındaki ilişkiyi ortaya koyan özel bir mülkiyet rejimini ifade etmektedir. Yasaların, mevcut uyuşmazlıkları kısa ve etkili yoldan çözüme kavuşturma hedefi kapsamında kat mülkiyeti yasası da yürürlüğe girdiği dönemde, uygulamadaki sorunları göz önüne alarak hazırlanmış, yasa metni, konular tek yapı düşüncesiyle, tek parsel esasına göre düzenlenmiştir. Değişen ekonomik koşullarla birlikte, kırsal kesimden büyük şehirlere göçün yaygınlaşması ile yaşanan nüfus artışı, tek parsel üzerinde blok inşaatların kurulmasını beraberinde getirmiştir. Toplu yapı kavramının yaygınlaşması ile, toplu yapı inşaatları sadece tek parsel üzerinde değil, birden fazla yapıların birden fazla imar parseline inşaası suretiyle gerçekleşmeye başlamıştır. Toplu yapı uygulamasının artması ile ortaya çıkan sorunlar, uyuşmazlıkların daha süratli ve etkili çözümlenmesi için Kat Mülkiyeti Yasası’nda yeni ve belli ölçüde ayrıntılı düzenlemelere yer verilmesini zorunlu kılmıştır. Bu düşünceden hareketle, yasa koyucu 5711 sayılı yasa ile birden fazla imar parseli üzerine kurulu toplu yapılar açısından da Kat Mülkiyeti Yasası’nı uygulanabilir hale getirmiştir. Tek parsel ve birden fazla parsel üzerinde kurulu yapılarda, uygulamada karşılaşılan en sık uyuşmazlık, ana gayrimenkule ait ortak yer ve tesislere ilişkin giderlerin kat malikleri tarafından üstlenilmesi ile ilgilidir. Bu bakımdan, inceleme konusu olarak Kat Mülkiyeti Yasası’nda Ortak Gider ve İfası seçilerek, konu, yasanın konu ile ilgili maddeleri değişiklik öncesi ve son şekliyle, öğreti ve Yargıtay kararları doğrultusunda aktarılmıştır. Kat mülkiyeti ilişkisinin temelini paylı mülkiyet rejiminin oluşturması sebebiyle, konu ile ilgili olduğu ölçüde paylı mülkiyet esaslarına da değinilmiştir. ABSTRACT COMMON EXPENSES IN PROPERTY OWNERSHIP AND ITS PERFORMANCE Property Law, as it is put into force, means a private ownership regime that describes independent units, each of which is a separate real property on a single parcel, and the relationship between the owners of those units. Under the scope of the purpose of the laws to find effective and fast solutions to the present disputes, the property law, at the time it was entered into force, was prepared considering the problems in practice, and the law text was regulated on the basis of single parcel and single structure. With the changing economical conditions, the increase in population as a result of the immigration from rural to urban areas brought block building constructions on a single parcel within. As the concept of mass housing began to spread, the mass housing constructions started to be performed as multiple structures on multiple zoning parcels, instead of a single one. The problems arising with the increase in mass housing applications have made it inevitable to make some reforms in the Property Law to solve the disputes faster and more effectively. From this point of view, the legislator has made the property law applicable for mass housings built on more than one parcel with the law no 5711. The most common conflict in practice of the building on a single and multiple parcel is about covering of the expenses of common places and facilities of the main real property by the owners. In this respect, the common expenses in property ownership and its performance was chosen as a research subject and analyzed considering the relevant articles of the law, before and after the amendment, and in line with the doctrine and the decisions of Supreme Court. As property ownership concept contains joint ownership regime within itself concerning especially the rights and responsibilities of the owners on common places, the fundamentals of joint ownership is also discussed to the extent it is related to the subject.
