Özet:

5237 SAYILI TCK’DA RÜŞVET SUÇU Rüşvet, hukukumuzda değişik tarihlerde değişik düzenlemelere konu olmuş bir suçtur. Bunlardan en sonuncusu ise 1 haziran 2005 tarihinde yürürlüğe giren 5237 sayılı Türk Ceza Kanunundaki düzenlemedir. Yüksek lisans çalışması olarak hazırlanmış bu çalışmamız üç bölüm olarak ele alınmıştır. Birinci bölümde; Genel açıklamalar, tarihi gelişim ve mukayeseli hukuktaki durumlar incelenmiştir. İkinci bölüm; rüşvet suçunun analitik olarak incelenmesine ayrılmış ve konu bütünlüğünün sağlanması maksadıyla geniş tutulmuştur. Bu bölümde; Rüşvet suçunun unsurları, suçun özel görünüş şekilleri, kusurluluk ve kusurluluğu etkileyen nedenler ile etkin pişmanlık halleri incelenmiştir. Çalışmanın üçüncü ve son bölümünde ise; Yargılama usulü, yaptırım ve rüşvet suçunun benzer suçlarla olan farkları üzerinde durulmuştur. CORRUPTION INFRACTION IN TURKISH CRIMINAL CODE NUMBER 5237 SUMMARY Corruption is an infraction which made the subject of our law on different dates in different arrangements. The last of these arrangements is the one in the Turkish Criminal Code with number 5237 which came into effect on June 1st, 2005. This study which has been prepared as a graduate study has been taken up in three parts. In the first part the general explications, the historical development and the comparative law cases have been studied. The second part has been dedicated to the analytical examination of the infraction and has been taken up largely to maintain the integrity of the subject. In this part; the components of the corruption infraction, the special aspects of the infraction, the malformation and the reasons effective the malformation are examined with the effective penitence circumstances. In the third and last part of the study; the proceedings and the differences between the sanction and the corruption infraction with the similar infractions have been focused.
